I. Parliament of
the Republic of
Kazakhstan

The legislative branch of government
in the Republic of Kazakhstan is
represented by a bicameral
Parliament.

According to the
Constitution of the
Republic of
Kazakhstan, the
Parliament is the
highest representative
body of the republic,
exercising legislative
functions.

Parliament consists of two
Chambers: the Senate and the
Mazhilis, acting on a permanent
basis.

SENATE

The Senate is formed by deputies
representing, in the manner prescribed by
the constitutional law, two people from
each region, city of republican significance
and the capital of the Republic of
Kazakhstan. Fifteen deputies of the Senate
are appointed by the President of the
Republic, taking into account the need to
ensure representation in the Senate of
national, cultural and other significant
interests of society.

The election of the Senate deputies
is carried out on the basis of
indirect suffrage by secret ballot.

9.

Half of the elected Senate
deputies are re-elected every
three years. The term of
office of the Senate deputies
is 6 years.

10.

A deputy of the Senate can be a
person who has reached thirty
years of age, has a higher
education and work experience of
at least five years, permanently
resides in the territory of the
relevant region, city of republican
significance or the capital of the
Republic for at least three years.

The exclusive jurisdiction
of the Senate includes:

1) election and dismissal of the Chairman
of the Supreme Court and judges of the
Supreme Court of the Republic on the
proposal of the President of the
Republic of Kazakhstan, taking their
oath;

13.

2) giving consent to the appointment by
the President of the Republic of the
Chairman of the National Bank, the
Prosecutor General, the Chairman of
the National Security Committee of the
Republic;

14.

3) deprivation of immunity of the
Prosecutor General, the President and
judges of the Supreme Court of the
Republic;

15.

4) fulfillment of the functions of the
Parliament of the Republic on the
adoption of constitutional laws and
laws during the period of the temporary
absence of the Mazhilis, caused by the
early termination of its powers;

5) exercise of other powers assigned by
the Constitution to the Senate of the
Parliament.

The Chamber is headed by the
President, elected by the Senate from
among the deputies who are fluent in
the state language, by secret ballot by a
majority of votes of the total number of
deputies of the Chamber. A candidate
for the post of Chairman of the Senate
is nominated by the President of the
Republic of Kazakhstan.

MAJILIS

The Mazhilis consists of 107 deputies. 98
deputies of the Mazhilis are elected from
political parties by party lists in a single
nationwide constituency on the basis of
universal, equal and direct suffrage by
secret ballot. 9 deputies of the Mazhilis are
elected by the Assembly of the People of
Kazakhstan.

The term of office of the
Mazhilis deputies is 5 years.

A person who has reached twentyfive years of age can be a deputy
of the Mazhilis.

The Mazhilis, by a majority of votes
from the total number of Mazhilis
deputies, on the initiative of at least
one fifth of the total number of
Mazhilis deputies, has the right to
express a vote of no confidence in
the Government.

The exclusive jurisdiction of
the Mazhilis includes:

1) acceptance for consideration of draft
constitutional laws and laws submitted
to Parliament and consideration of these
drafts;

2) by a majority vote of the total number
of deputies of the Chamber, giving
consent to the President of the Republic
for the appointment of the Prime
Minister of the Republic;

3) the announcement of the next elections
of the President of the Republic;

28.

4) exercise of other powers assigned by
the Constitution to the Mazhilis of the
Parliament.

The Chamber is headed by a Chairman
elected by the Mazhilis from among the
deputies who are fluent in the state
language, by secret ballot by a majority
of votes from the total number of
deputies of the Chambers. Candidates
for the position of the Chairman of the
Mazhilis are nominated by the deputies
of the Chamber.

II. Government of the
Republic of
Kazakhstan

The Government of the Republic of
Kazakhstan exercises executive power,
heads the system of executive bodies and
manages their activities. The Head of
Government is appointed by the President
after approval of the candidacy of the Prime
Minister by the majority of the Parliament
of the Republic of Kazakhstan. The personal
composition of the Government is appointed
by the President upon the nomination of the
Prime Minister.
